- Nature of financial markets and varieties of financial and investment activity - Regulation of UK financial markets : risks, regulatory techniques and regulatory institutions from 1974 to 21st century - Collective investment schemes – the constitutive role of private and regulatory law - Private and regulatory law standards and obligations surrounding financial advice and product distribution - Retirement saving and protection products – lessons from past regulatory failures - Enforcement and redress in financial markets - Regulatory accountability and the law - Prudential regulation of financial institutions – safety, soundness and systemic resilience
Learning Outcomes
By the end of the module students should be able to:
Demonstrate knowledge of policy objectives and background to the development of financial regulatory law relevant to banks and financial institutions
Identify the risks that have accompanied development of financial markets
Demonstrate critical understanding of nature, implementation and enforcement apparatus of financial regulatory law at the level of major UK and EU financial markets.
Apply the above knowledge and understanding to some commercial case studies and hypothetical scenarios.
Understand the role of law and legal and regulatory processes in the financial sector and its constituent products
