Exclusions
Description The module covers:
  • Civil Law concept of “Things”.
  • Historical origins of French property law.
  • Constitutional and sociological foundations of property law.
  • Constitutive elements of ownership. Characteristics of ownership.
  • 'Troubles du voisinage'.
  • Constructive elements of possession.
  • Legal conditions of possession.
Learning Outcomes By the end of the module students should be able to:
  • Demonstrate knowledge and understanding of the key principles and theories of ownership and possession in France;
  • Summarise the main issues and debates in French property law;
  • Show understanding of some of the main differences between French law (Civilian tradition) and English law (Common law tradition);
  • Summarise and evaluate French property law cases in the French language;
  • Read and assess critically French academic writings in these areas;
  • Draft essays and case notes using French drafting methods and French language;
  • Bring together and present coherently materials from primary and secondary sources which deal with the issues addressed;
  • Make a personal and reasoned judgment based on an informed understanding of standard arguments in the areas covered.
