Exclusions
Description The module covers:
  • Legal effect of possession for immovables: the doctrine of "usucapion or prescription acquisitive";
  • Legal effect of possession for movables: "possession of movable property is equivalent to title";
  • Acquisition of ownership by 'Occupation';
  • Acquisition of ownership by 'Accession';
  • Acquisition by contract;
  • Protection and proof of ownership;
  • Loss of ownership;
  • Usufruct;
  • 'Servitudes'.
Learning Outcomes By the end of the module students should be able to:
  • Demonstrate knowledge and understanding of the key principles and theories of ownership and possession in France;
  • Summarise the main issues and debates in French property law;
  • Show understanding of some of the main differences between French law (Civilian tradition) and English law (Common law tradition);
  • Summarise and evaluate French property law cases in the French language;
  • Read and assess critically French academic writings in these areas;
  • Consolidate the French case report technique and develop oral communication skills in French;
  • Draft essays and case notes using French drafting methods and French language;
  • Bring together and present coherently materials from primary and secondary sources which deal with the issues addressed;
  • Make a personal and reasoned judgment based on an informed understanding of standard arguments in the areas covered.
