Introduction to the law of tort, including, for example, its historical origins, its theoretical underpinnings and its aims and functions; negligence, including public authority liability and liability in respect of omissions, psychiatric harm and pure economic loss; and nuisance.
In addition at least one of the following topics will be covered:
alternative compensation systems; intentional torts; defamation.
Learning Outcomes
By the end of this module students should be able to:
Demonstrate knowledge and understanding of the law of tort in its social, economic and historical context;
Apply legal principles to reasonably complex situations;
Draw upon the results of independent legal research in order to evaluate the doctrinal, economic and moral dimensions of the law of tort, drawing on both primary and secondary sources;
Articulate reasoned arguments on issues relating to tort law in a cogent and coherent manner;
Synthesise and critically evaluate a diverse range of legal source material and argument, including judicial techniques of precedent, statutory interpretation, and academic commentary in order to form reasoned conclusions on one or more areas of Tort law.
