Exclusions
Description The jurisdiction of the English courts and the recognition and enforcement in the UAE and England of foreign judgements in commercial matters; a detailed study of the choice of law rules in the fields of contract, tort and international sales. These issues are examined both under the common law rules and under the applicable European regulations and international conventions.
Learning Outcomes By the end of the module students should be able to:
  • Analyse critically and in depth the principal issues involved in international commercial litigation and demonstrate more advanced skills in writing a research paper.
  • Demonstrate understanding of and be able to critically analyse the rules of jurisdiction applicable in the courts of England and Wales including the common law principles that have influenced the rules of jurisdiction of courts in free zone areas such as DIFC court in Dubai.
  • Show understanding of and be able to critically analyse the rules of recognition and enforcement applicable in the courts of England, Wales and the UAE.
  • Show understanding of and be able to critically analyse the rules of applicable law which relate to contractual and non-contractual obligations.

Assessment Methods & Exceptions Assessment:
3000 word essay (75%) and group presentation (5 minutes per person) (25%)
