The aim of this module is to provide students with a general understanding of DIFC court litigation. This module encompasses an examination of the following aspects: a general introduction to DIFC courts as an independent forum in the UAE for resolving disputes related to financial and commercial matters; an examination of the different laws and regulations that govern DIFC litigation, such as the DIFC Courts Law and the DIFC Arbitration Law; DIFC jurisdiction and the cases that fall under the jurisdiction of DIFC Courts; the DIFC Courts' structure, with an analysis of the respective functions of the Court of First Instance and the Court of Appeal; the main procedural rules that apply in the context of litigation before DIFC courts, from the lodging of a claim until the issuance of the final judgment; rules of evidence before DIFC courts; challenging DIFC courts' decisions; and enforcement of judgments issued by DIFC.
